A writ petition has been registered in the Supreme Court challenging the government’s recent decision to impose a travel ban and freeze passports of former Prime Minister KP Sharma Oli along with four other high-ranking individuals.

 

Advocate Premraj Silwal filed the petition on Tuesday, arguing that the move by the inquiry commission formed after the incidents of September 8 and 9 is unconstitutional and unlawful. The commission, headed by former judge Gauri Bahadur Karki, had barred Oli, former Home Minister Ramesh Lekhak, former Home Secretary Gokarnamani Duwadi, former intelligence chief Hutaraj Thapa, and former Chief District Officer of Kathmandu Chhabilal Rijal from leaving the Kathmandu Valley and suspended their passports.

 

The writ claims that the decision violates fundamental rights guaranteed by Nepal’s Constitution, including the right to live with dignity and freedom of movement. The petitioner has requested the Supreme Court to annul the decision and issue an order preventing such restrictions in the future without due process.

 

According to court officials, the registration process is still under review. Meanwhile, over ten other constitutional petitions related to parliament dissolution and government formation remain pending, with hearings scheduled to begin on Wednesday.
