The Supreme Court of Nepal has issued a show-cause order regarding the appointment of Saroj Kumar Yadav as Chief Minister of Madhesh Province, following a petition claiming the process violated constitutional procedures. The case was filed by Rakki Prasad Sah and Sujit Yadav, listing the Province Chief’s Office, CM’s Office, and Provincial Assembly as respondents.
Yadav of CPN-UML was appointed by Province Chief Sumitra Subedi Bhandari under Article 168(3), allowing the largest party’s leader to form the government. The process sparked controversy after Bhandari, citing illness, administered Yadav’s oath at a hotel in Sindhuli, bypassing standard protocol.
Following criticism, Bhandari was removed from office on the recommendation of the Council of Ministers, with President Ramchandra Paudel approving her dismissal. The cabinet has now proposed Surendra Labh Karna as the new Province Chief.
The Supreme Court’s order seeks clarification on the legality of Yadav’s appointment, as Madhesh Province remains in political uncertainty.
