The Supreme Court of Nepal has directed authorities to produce the original case file in connection with a habeas corpus petition filed on behalf of medical entrepreneur Durga Prasai.
A joint bench of Justices Dr. Nahakul Subedi and Meghraj Pokharel on Monday ordered the Office of the Attorney General to present all original documents related to the arrest and investigation. The directive came during a hearing on the petition challenging Prasai’s detention.
According to a written response submitted by the District Police Range, Kathmandu, Prasai was arrested following a letter dated 2082/11/04 from the Election Commission of Nepal instructing authorities to investigate and take action against him.
Taking note of the police response, the bench sought the Commission’s correspondence as well as the original decision authorizing the investigation and subsequent arrest. The documents are to be submitted through the Office of the Attorney General for the court’s review.
The next hearing in the case has been scheduled for Tuesday.
