Khamm Bahadur Khati, coordinator of the Nepali Congress Election Committee, has stated that the Gagan Thapa faction has no authority to update or represent the party. Speaking to Congress leaders who visited the Election Commission on Friday to claim official recognition, Khati said that many of the signatories of the special general convention have withdrawn, submitting their signatures as proof.
He expressed confidence that the Election Commission will make its decision based on the constitution, prevailing laws, the Election Act, and the Political Parties Act, without violating any legal provisions. Out of 167 central committee members, 123 still remain with the regular faction. According to Section 44 (Ka) of the Political Parties Act, if a dispute arises, the majority of the previous central working committee is entitled to the party’s election symbol, name, and flag.
Khati said, “We have submitted documents as proof showing that representatives who initially signed for the special general convention have withdrawn. The Election Commission will make its decision based on evidence and the law, not on misleading media reports. The so-called 51 percent claim by the special convention faction is not valid, and the regular Nepali Congress majority still holds. According to Section 44 of the Political Parties Act, in case of disputes, the majority of the previous central committee retains the party symbol, name, and flag. We are confident. What the media says is not important; what the constitution, laws, and regulations say is important.”
He also stated that the special general convention did not even reach the 51 percent threshold of delegates and was called in violation of the party constitution.
