Confusion Deepens Over Action Against GenZ Protest Offenders as Home Ministry, Inquiry Commission Differ

Uncertainty has grown over how to proceed with legal action against individuals involved in the GenZ Movement protests, after the Home Ministry and the Judicial Inquiry Commission expressed conflicting positions.

 

The dispute centers on whether those accused of criminal offenses during the protests should face immediate prosecution. Commission member Bikyan Raj Sharma, from the panel led by former Special Court Chair Gauri Bahadur Karki, clarified that criminal cases can be pursued through regular legal channels without waiting for the commission’s final report.

 

Earlier, on September 25 (Ashoj 9), the Home Ministry had directed officials not to take immediate action on cases falling under the commission’s jurisdiction until it completed its investigation. Home Minister Om Prakash Aryal had also instructed all 77 Chief District Officers to refrain from arresting protest participants while the inquiry was ongoing, leading to the release of several suspects accused of looting and arson.

 

A police officer in Kathmandu said this has caused confusion among law enforcement. “We freed suspects following ministry orders, but now the commission says police action isn’t restricted. We’re unsure what to follow,” the officer stated.

 

The Home Ministry’s earlier statement had outlined that the commission’s role was to analyze reports and provide recommendations, after which the government would act legally. Sharma, however, emphasized that the commission’s job is to handle special inquiries and should not obstruct regular criminal procedures.

 

Experts, including former Home Secretaries, have warned that delaying criminal investigations until the commission’s report would undermine accountability and weaken justice delivery.

 

The ongoing lack of coordination between the two institutions has stalled the accountability process, leaving the police uncertain and the public concerned that those responsible for violence and destruction may escape punishment.
