A division bench of Supreme Court justices Kumar Chudal and Nityananda Pandey has refused to issue an interim order in a writ that Kulman Ghising had filed challenging his recent dismissal as the managing director of the Nepal Electricity Authority.
Still, the bench stated that the writ will get priority.
The ruling that followed marathon hearings (since April 1) on separate cases from Ghising and Hitendradev Shakya, the newly-appointed executive director of the state-owned power utility, means Shakya will get to continue as the chief of the state-owned power utility.
Ghising had moved the court on March 27 citing 'malafide intention', three days after the government dismissed him months before his retirement, citing poor performance, and appointed Shakya as the ED.
Shakya, removed four years ago and replaced by Ghising when Sher Bahadur Deuba was the prime minister, had subsequently moved the court challenging the government decision.
Pointing out at delays in delivering a verdict in his four-year-old case, Shakya had filed a fresh writ stating that Ghising’s case cannot be heard without settling the four-year-old case.
